Race for Kids Virtual Fitness Fundraiser
These terms and conditions (Terms) apply to your participation in the Race for Kids event (the Event). The Event is a virtual fundraising initiative that encourages the community to walk, run or move 1km every day throughout the month of May and is hosted by A.B. Paterson College Foundation Ltd ABN 60 623 295 483 (the Foundation, we, us, our) the Funraisin platform (Platform).
These Terms enable the Foundation to operate the Event safely and effectively.
By registering, fundraising for, accessing the Platform, donating or otherwise participating in the Event, you acknowledge that you have read and understood these Terms and you accept and agree to be bound by these Terms.
1. ELIGIBILITY
1.1. Registration for the Event is open to individuals who are aged:
(a) 18 years or above at the date of registration; and
(b) under 18 years of age at the date of registration, provided that a legal guardian has read these Terms and accepts them on the minor’s behalf,
(on acceptance of registration, each a
Participant).
1.2. When registering on behalf of an individual other than yourself, you represent and warrant that you have the legal authority to:
(a) complete such registration; and
(b) bind each person you register to these Terms.
1.3. The Foundation reserves the absolute discretion to accept or refuse any registration, or to remove any Participant from the Event, for any reason, including non-compliance with these Terms, provision of false, incomplete or misleading information, posing of a safety or security risk, or otherwise acting in a manner deemed inappropriate or prejudicial to the Event or the Foundation.
2. REGISTRATION AND PARTICIPATION
2.1. Participant registration is subject to acceptance by the Foundation and will be confirmed in writing, including via email, once the completed registration form, any required registration fee, and supporting documentation have been received and assessed.
2.2. Registration is available only through the Platform. If you encounter any difficulties, please contact us at foundation@abpat.qld.edu.au, and a member of our team will assist you with the online registration process.
2.3. By registering for the Event, each Participant:
(a) warrants and declares that they are medically and physically fit to participate in the Event;
(b) warrants and declares that the location(s) at, and times, which they will participate in the Event allows their participation in a safe manner; and
(c) acknowledges that participation is voluntary and at their own risk.
2.4. If a Participant is aware they have a medical condition, or are unsure of their ability to safely participate in the Event, they should consult their doctor before participating in the Event.
3. PARTICIPANT SAFETY AND WELLBEING
Health and safety
3.1. Each Participant:
(a) is responsible for their own health, safety and well-being; and
(b) must ensure that their participation in the Event is conducted safely and does not expose themselves or others to any risk to health and safety.
3.2. A Participant must:
(a) immediately cease participation in the Event if they experience any pain, discomfort, dizziness or other health concerns; and
(b) familiarise themselves with the nearest first-aid facilities, should medical attention be required.
Virtual and off-site participation
3.3. Participants acknowledge that the Foundation will not provide any on-ground health or safety support for any virtual or off-site participation in the Event.
3.4. Participants remain fully and solely responsible for:
(a) selecting a safe route;
(b) their personal belongings;
(c) ensuring any equipment they use when participating in the Event is safe, suitable and fit for purpose;
(d) complying with health advice; and
(e) following local laws and directions, such as Queensland road rules and traffic directions.
3.5. The Foundation is not responsible for any fines, penalties, or legal consequences arising from a Participant’s failure to comply with any direction or law.
Supervision of Participants under the age of 18
3.6. Participants under the age of 18 must be supervised by a responsible adult at all times during participation in the Event.
4. RIGHT TO MODIFY, POSTPONE OR CANCEL
4.1. The Foundation may at any time modify, postpone or cancel the Event.
4.2. To the extent permitted by law, the Foundation is not liable for costs, losses, or damages arising from any modification, postponement or cancellation.
5. FUNDRAISING
Donations
5.1. Donations may be made via the Platform or through any other method specifically permitted by the Foundation.
5.2. Donation records, and other payment information, are collected and maintained in accordance with our Privacy Policy.
Allocation and use of funds
5.3. Funds raised for the Event will support:
(a) the Gold Coast Hospital Foundation ABN 95 387 912 125, to be directed to approved paediatric initiatives at Gold Coast University Hospital, supporting improved patient experience and health outcomes for children; and
(b) the Foundation, to be applied in pursuit of the Foundation’s objects.
5.4. The Foundation will comply with all applicable state, territory, and federal fundraising laws.
Payment processing
5.5. Payments, including donations, for the Event are processed securely using a payment gateway that complies with the Payment Card Industry Data Security Standards (PCI DSS) and is authorised for use in Australia. No complete bank or card details are stored by the Foundation.
5.6. The Foundation is not liable for delays or errors in payment processing caused by third-parties, technical failures, or other circumstances beyond our reasonable control.
5.7. In the event of a technical failure, Platform outage or unauthorised transaction, the Foundation will endeavour to resolve and rectify such issues promptly.
Transparency
5.8. The Foundation will publish fundraising outcomes via the Platform, email communications or on the Foundation’s website within 30 days after the conclusion of the Event.
Cancellations, Changes and Refunds
5.9. Donations are non-refundable, except where required by law or in special circumstances.
5.10. If the Event is cancelled or is unable to proceed after it has commenced due to circumstances outside the Foundation’s reasonable control , including, but not limited to:
(a) cyber-attacks, computer viruses, technical failures, Platform outages;
(b) natural disasters, severe weather events, emergency situations, or safety concerns; or
(c) government regulation or intervention,
all net profit raised up to the point of cancellation will be distributed in accordance with clause 5.3 above.
5.11. Requests for refunds must be submitted to the Foundation, in writing, within 14 days of the payment transaction. The Foundation is not required to issue any refund except as contemplated in these Terms.
Tax deductions
5.12. If requested, the Foundation will issue tax-deductible receipts for donations as permitted.
6. PRIVACY
6.1. The Foundation is committed to respecting your privacy and protecting the confidentiality and security of any personal information you provide. We take all reasonable steps to ensure that your personal information is safeguarded against misuse, loss, interference, unauthorised access, modification or disclosure, in accordance with our Privacy Policy.
6.2. Your personal information may be shared with trusted third‑party service providers involved in the administration, management, insurance, or delivery of the Event. This may include technology platforms, payment processors and fundraising systems used to operate the Event, particularly:
(a) Made With Ed Pty Ltd t/as Funraisin ABN 90 147 629 150 (Funraisin) operates the Platform, supporting the Event’s fundraising system and retaining personal information necessary to assist with the Foundation’s operation of the Event. Funraisin’s privacy policy can be found at: https://www.funraisin.co/privacy-policy/; and
(b) Stripe Payments Australia Pty Ltd 66 160 180 343 (Stripe), an accredited payment gateway that complies with the Payment Card Industry Data Security Standards, is used to process payment information for the Event. Stripe’s privacy policy can be found at: https://stripe.com/au/privacy.

7. MEDIA AND DISPLAY ON PLATFORM
7.1. For privacy reasons:
(a) Participants cannot upload personal profile photographs to the Platform; and
(b) only first letter of each Participant’s surname will be displayed (for example, “John Smith” will appear as “John S”).
8. USE OF THE PLATFORM
8.1. Participants and donors:
(a) must not use the Platform in any manner, including when providing information, that is unlawful, misleading, defamatory, fraudulent, or infringes the rights of others; and
(b) must not interfere, disrupt, or attempt to harm the operation of the Platform.
9. INTELLECTUAL PROPERTY
9.1. All intellectual property rights in the Foundation or Event branding, or associated materials, are owned by the Foundation.
9.2. Participants must not use, copy, distribute, or adapt materials to which the Foundation’s intellectual property rights attach, except as expressly permitted by the Foundation.
10. LIABILITY, DISCLAIMERS AND INDEMNITY
10.1. To the maximum extent permitted by law, the Foundation and its representatives will not be held liable for any loss, damage, cost or other liability suffered or incurred by any Participant or donor in connection with the Event or use of the Platform, including without limitation:
(a) personal injury, illness or death;
(b) property loss or damage;
(c) technical errors, delays or failures in the Platform or payment processing;
(d) incorrect, incomplete or misleading information provided by Participants or donors, or arising from third-party conduct; or
(e) indirect, consequential, or economic loss.
10.2. Each Participant and donor indemnifies and holds harmless the Foundation, and its representatives and affiliates, from and against any loss, damage, claim or expense arising from a breach of these Terms, unlawful conduct, or participation in the Event.
10.3. Nothing in these Terms excludes, restricts, or modifies any right or remedy conferred by the Australian Consumer Law.
11. COMMUNICATIONS
11.1. By participating in the Event, you consent to receiving communications about:
(a) the Event, via email and related digital platforms; and
(b) future opportunities to support the Foundation’s work.
11.2. Participants remain responsible for checking Event updates.
11.3. You may update your communication preferences by notifying the Foundation in writing.
12. GENERAL
12.1. These Terms are governed by and construed in accordance with the laws of the State of Queensland, Australia.
12.2. The Foundation may amend these Terms at any time. The Terms applicable:
(a) to a Participant’s participation, are those that are in effect at the time of registration; and
(b) in respect of a donor’s donation, are those in effect at the time of the relevant donation,
unless amended Terms have been accepted.
